1.Partner Visa

Partner Visa (Subclass 820) – Temporary Partner Visa
The Partner Visa (Subclass 820) is a temporary visa that allows the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to live in Australia. It is the first step towards obtaining the Permanent PartnerVisa (Subclass 801).

To apply for a Subclass 820 visa, the applicant must meet the following criteria:
1. Relationship Requirements
Be the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen.
The relationship must be genuine and ongoing.
If in a de facto relationship, the couple must have been together for at least 12 months before applying (unless an exemption applies, such as registering the relationship in an Australian state or territory).
If married, the marriage must be legally recognized under Australian law.
2. Sponsor Requirements
The applicant must have an eligible sponsor, who is usually their Australian partner.
The sponsor must meet character requirements and provide supporting evidence of their commitment to the relationship.
3. Character & Health Requirements
The applicant must meet health and character requirements (e.g., police checks and health examinations).
Any dependent family members included in the application must also meet these requirements.
4. Visa Conditions
Applicants must be in Australia at the time of application and when the visa is granted.
Holding a substantive visa (if already in Australia) is generally required to avoid additional restrictions.
Pathway to Permanent Residency
After holding the Subclass 820 visa for at least two years, applicants can be assessed for the Permanent Partner Visa (Subclass 801).
If the relationship ends due to exceptional circumstances (e.g., domestic violence or the partner’s death), the applicant may still be eligible for the permanent visa.
Partner Visa (Subclass 801) – Permanent Partner Visa
The Partner Visa (Subclass 801) is a permanent visa that allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia permanently. This visa is granted to applicants who have already been granted the Temporary Partner Visa (Subclass 820) and have met all the requirements for permanent residency.

The Subclass 801 visa is the second stage of the Partner Visa process. You must already hold a temporary Subclass 820 visa before applying.
2. Be in a Genuine and Ongoing Relationship
The applicant must prove they are in a genuine, committed, and continuing relationship with their Australian partner.
3. Meet the Relationship Requirements
