Thinking of joining your partner in Australia? Whether you’re married or in a de facto relationship, Australia’s Spouse (Partner) Visa is your golden ticket to building a life together Down Under. But before you dive into the application, here’s everything you need to know.
What is the Australian Spouse Visa?
The Australia Spouse Visa, officially called the Partner Visa, allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. There are two main pathways, depending on whether you’re applying from within Australia or overseas.
- Partner Visa (Subclass 820/801): For applicants already in Australia.
- Partner Visa (Subclass 309/100): For applicants applying from outside Australia.
Each pathway is a two-stage process- starting with a temporary visa (820 or 309), and after a period (usually 2 years), leading to the permanent visa (801 or 100).
What Do You Need to Qualify?
What is the key requirement? Proof of a genuine and continuing relationship. Whether you’re legally married or in a de facto relationship, you’ll need to show:
- Shared finances and responsibilities
- Join travel or household arrangements
- Social recognition as a couple
- A mutual commitment to a shared life
De facto couples must usually prove they’ve been living together for at least 12 months- unless registered under an Australian state or territory relationship scheme.
